This was a proposed rule. Not an EO. Did it become a rule?
The Executive proposes rules all the time. It's not under Congress' purview, but the president, by his agencies.
A proposed rule becomes a rule after a period of public comment. Unless
the public turns up the heat, a proposed rule probably becomes a rule.
You should probably be more outraged about administrative law in general than by the prez promulgating a few EOs.
